    TERMS OF USE 

    "Scrapert", a unit of Get Max Value Private Limited, provides an online platform for the collection, refurbishment, and ethical disposal of scrap. By using our Platform, you (hereinafter “you,” “the Party,” or “the Seller” or “the user”) agrees to comply with these Terms of Use. These Terms govern Seller’s right to use the Platform to sell used, surplus, or scrap items, including (but not limited to) electronics, furniture, household appliances, industrial machinery, and related assets. 

     

    1. OVERVIEW OF SERVICES 

    Scrapert operates as a direct-to-consumer (D2C) scrap management platform that facilitates the sale of scrap to refurbishers, reuse sellers, or certified recyclers. We coordinate with third-party professionals ("Service Providers") for technical, security, and logistics services. Scrapert acts solely as a facilitator. Disclaimer: Scrapert and Get Max Value Private Limited shall not be held responsible for uninstallation failures, any damage to property, or any service deficiencies—including those caused by third-party Service Providers—arising at Seller’s premises (residential, commercial, or otherwise). 

     

    2. ACCOUNT REGISTRATION 

    To use the Platform, Seller must be at least 18 years old and provide accurate information during account creation. Seller is solely responsible for all activities that occur on Seller’s account and must notify us immediately of any unauthorized use. 

     

    3. BOOKINGS & PAYMENTS 

    Bookings may be made only through the Platform for available time slots. All charges, including service fees, platform fees, applicable taxes, and additional fees—are clearly displayed and are subject to Scrapert’s cancellation policy. By confirming an order, you acknowledge that you have accepted the charges displayed, and once Seller’s order is confirmed, it is deemed that you agree to the final payment calculations as provided by Scrapert, after applicable deductions. Scrapert shall make final payments if soever to be made in the bank account provided by the Seller or the (UPI ) Unified Payments Interface id or phone number associated with UPI provided to Scrapert 

     

    4. SCRAPERT CREDITS 

    Scrapert may, from time to time, issue promotional credits which are non-transferable, non-cashable, and subject to expiry as per Scrapert’s marketing policy. Misuse or unauthorized distribution of these credits may result in account restrictions. Such credits are offered solely at Scrapert’s discretion and do not create an obligation or liability on the part of Scrapert or its employees. 

     

    5. USER CONDUCT 

    Seller agrees to treat all Service Providers with respect and provide a safe environment during service provision. Any abuse, discrimination, or creation of unsafe conditions may result in denied services and/or account termination. Reports of misconduct by Service Providers must be submitted within 48 hours at support@getmaxvalue.in. 

     

    6. USER CONTENT AND PRIVACY 

    By submitting feedback or reviews ("User Content") on the Platform, Seller grants Scrapert permission to use such content for operational and promotional purposes. All personal data is managed in accordance with our Privacy Policy. 

     

    7. PLATFORM RESTRICTIONS 

    You agree not to: 

    • Use the Platform for any unlawful purposes. 

    • Copy, distribute, or modify any content from the Platform without prior written consent. 

    • Interfere with the integrity or security of the Platform. 

    • Solicit services independently outside the Platform. 

     

    8. SERVICE LIMITATIONS 

    Scrapert does not warrant that the Platform or services will be continuously available or free of errors. All issues or service interruptions must be reported to support@getmaxvalue.in. Disclaimers: Scrapert, its affiliates, and Get Max Value Private Limited shall have no liability for any errors, service interruptions, delays, or damages (whether direct or indirect) arising from Seller’s use of the Platform or reliance on the services provided. 

     

    9. TERMINATION 

    Scrapert reserves the right to suspend or terminate Seller’s access to the Platform for any violation of these Terms or any misuse of the Platform. You may close Seller’s account by contacting customer care at support@getmaxvalue.in. 

     

    10. LIABILITY & WARRANTY 

    10.1 Services Provided “As-Is”: All services on the Platform are provided on an “as-is” and “as available” basis with no warranties of any kind, whether express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose. 

    10.2 Limitation of Liability: To the maximum extent permitted by applicable law, Scrapert and Get Max Value Private Limited, including their affiliates, officers, directors, employees, agents, and Service Providers, shall not be liable for any: 

    • Direct, indirect, incidental, consequential, special, or punitive damages, 

    • Loss of profits, revenues, or data, 

    • Interruptions of service, 

    • Any other damages arising from or related to Seller’s use of the Platform, or the services provided, even if advised of the possibility of such damages. 

    10.3 Aggregate Liability: In any event, the combined aggregate liability of Scrapert and Get Max Value Private Limited for any claims arising from Seller’s use of the Platform shall not exceed the greater of INR 10,000 or the platform fee you have paid for the transaction. The provisions of this section shall apply to the fullest extent permitted by applicable law.

     

    11. INDEMNIFICATION 

    You agree to indemnify, defend, and hold harmless Scrapert, Get Max Value Private Limited, and their respective affiliates, officers, directors, employees, agents, and Service Providers from and against any and all claims, liabilities, losses, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with Seller’s use of the Platform, any violation of these Terms, or any infringement by you of any intellectual property or other rights of any person or entity. 

     


    12. DISPUTE RESOLUTION 

    These Terms are governed by and construed in accordance with Indian law. Any disputes shall be resolved solely by arbitration under the Arbitration and Conciliation Act, 1996, with arbitration proceedings to be held in New Delhi. By using the Platform, you irrevocably consent to the jurisdiction of the arbitration forum.


    13. MISCELLANEOUS 

    Updates: Scrapert may update or modify these Terms of Use at any time without prior notice. Continued use of the Platform after any such changes shall constitute Seller’s acceptance of the revised Terms. 

    Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect. 

    Assignment: You may not assign Seller’s rights under these Terms without our express written consent. 

    Entire Agreement: These Terms, along with any policies referenced herein, constitute the entire agreement between you and Scrapert with respect to the subject matter hereof.


    14. By using Scrapert’s services, you agree to these Terms of Use in their entirety.
